The terms for using this website, and the standard terms for consulting and advisory services I provide.

1. About these terms

borisdesmond.com is operated by Boris Desmond, a sole trader based in Victoria, Australia (ABN 67 715 582 190). By using this website you accept the website terms below. The service terms apply when you engage me, alongside any proposal or engagement letter we agree. If a proposal says something different, the proposal wins.

2. This website

This website is informational. It describes my services but is not itself an offer or a binding quote. Statistics and results on this site reflect my own records at the time of writing; they are not a promise of similar results for your business.

The content on this site (text, images, layout and code) belongs to me unless stated otherwise. You may read and share it for personal, non-commercial purposes, but not copy, republish or use it to train AI models without written permission. Company names mentioned belong to their owners and appear to describe past work.

You must not use this site to attempt unauthorised access to any system, send spam or unsolicited offers through the contact form, or do anything unlawful.

3. Services

I provide sales strategy, fractional sales leadership, AI implementation and one-to-one advisory services to businesses. The scope, deliverables, timing and fees of each engagement are set out in a written proposal or engagement letter that we both agree before work starts.

4. Fees and payment

• Fees are quoted in Australian dollars. I am not currently registered for GST, so no GST is charged.
• Advisory sessions and packages are paid in advance. Project and fractional work is invoiced as set out in the proposal, usually monthly in advance or by milestone.
• Invoices are payable within 7 days unless the proposal says otherwise. Payments may be made by card through Stripe or by bank transfer.
• I may pause work on an engagement while an invoice is overdue.

5. Rescheduling, cancellation and refunds

• Sessions: you can reschedule or cancel a booked session at no cost with at least 24 hours' notice. Sessions cancelled with less notice, or missed, may be counted as used.
• Prepaid packages: if you end a package early, I'll refund any sessions not yet delivered, less any discount that applied to buying the package.
• Fractional and project work: either party can end an engagement with the notice period in the proposal (14 days if none is stated). You pay for work done up to the end of the notice period; any amount prepaid beyond that is refunded.
• Refunds are made to the original payment method within 10 business days.

Nothing in these terms limits your rights under the Australian Consumer Law.

6. Confidentiality

I keep your business information confidential and only use it to deliver the engagement, unless you agree otherwise or the law requires disclosure. I'm happy to sign a reasonable NDA before we start.

7. Advice and results

My advice is given in good faith and based on my experience. Sales and business results depend on many factors outside my control, so I don't guarantee specific outcomes such as revenue, leads or meetings. You remain responsible for decisions you make in your business.

8. Liability

To the extent permitted by law, I'm not liable for indirect or consequential loss (including lost profits) arising from this website or my services, and my total liability for an engagement is limited to the fees you paid me for it. This does not exclude any liability that cannot be excluded under the Australian Consumer Law.

9. Governing law

These terms are governed by the laws of Victoria, Australia, and the courts of Victoria have jurisdiction over any dispute.

10. Changes

I may update these terms from time to time. The version on this page applies from the date shown above; agreed proposals continue on the terms in place when they were signed.
